These Terms of Sale ("Terms") govern any purchase made on kairoseye.com. By completing a purchase, you agree to these Terms in full.

As a micro-entreprise operating under the VAT exemption regime (franchise en base de TVA, Article 293 B of the French Tax Code), no VAT is charged. Prices shown are final all-inclusive prices.


2. Subject

These Terms apply to the sale of a Supporter license ("License") for the KairosEye Garmin watchface application. The License is a one-time, non-subscription digital entitlement that unlocks premium features permanently for the buyer.

These Terms are intended for consumers (B2C) only. KairosEye does not sell to businesses or professionals.


3. Products and Features

3.1 Free tier

KairosEye is freely available without purchase and includes:

  • All supported Garmin watch models
  • Weather forecast at 3-hour resolution
  • 1 Google Calendar sync (every 6 hours)
  • Moon phase, sunrise/sunset, health stats
  • Interface customization
  • IP-based localization

3.2 Supporter License (paid)

Purchasing a Supporter License unlocks, on top of the free tier:

The License is tied to your license key, not to a specific Garmin device or account. Switching to a new watch does not require a new purchase.


4. Pricing

Both tiers unlock identical premium features. The difference is solely the amount of financial support provided to the project.

Prices are displayed in euros (€), inclusive of all taxes (no VAT applicable, see Section 1). The seller reserves the right to modify prices at any time; the price applicable to an order is the one displayed at the time of purchase.


5. Ordering and Payment

5.1 Order process

  1. Select a contribution amount on the Contribute page.
  2. You are redirected to a Stripe-hosted payment page.
  3. Enter your payment details and confirm the order.
  4. Upon successful payment, Stripe sends a confirmation email and triggers license activation.

5.2 Payment

Payments are processed exclusively by Stripe, Inc. via a secure hosted page. The seller never receives or stores your payment card details.

Accepted payment methods are those offered by Stripe at the time of purchase (typically: credit/debit cards, Apple Pay, Google Pay).

5.3 Order confirmation

An order is considered confirmed once payment has been successfully processed by Stripe. You will receive a confirmation email at the address provided during checkout.


6. License Delivery

Upon successful payment, a license key is delivered to the email address provided at checkout. No KairosEye account is required prior to purchase. The key is entered in the KairosEye app or web interface to activate premium features.

No physical delivery takes place.

The license key is permanent. Keep it in a safe place. If you lose it, contact [email protected] with your Stripe receipt and your key will be resent.


7. Right of Withdrawal

7.1 General rule

Under European consumer law (Directive 2011/83/EU, transposed in Articles L221-18 et seq. of the French Consumer Code), consumers have a 14-day right of withdrawal from the date of purchase.

7.2 Exception — digital content

Pursuant to Article L221-28, 13° of the French Consumer Code, the right of withdrawal does not apply to the supply of digital content not provided on a tangible medium where performance has begun — with the consumer's prior express consent and acknowledgment that the right of withdrawal is thereby lost.

By completing your purchase, you expressly consent to the immediate delivery of the digital License and acknowledge that you thereby waive your right of withdrawal.

7.3 Exceptional refunds

Notwithstanding the above, refund requests may be considered on a case-by-case basis within 14 days of purchase if:

  • The License was not activated despite successful payment, and the issue could not be resolved within a reasonable time; or
  • A technical defect makes the premium features entirely unusable and cannot be remedied.

8. Legal Warranties

As a digital content provider, the seller is subject to the legal warranty of conformity for digital content (Articles L224-25-12 et seq. of the French Consumer Code). The KairosEye Supporter License will function as described in Section 3.2 for the duration of its use.

The License covers all current and future Garmin watch models supported by KairosEye, as well as all watchface designs published by KairosEye. No additional purchase is required when new compatible models or new KairosEye watchfaces are released.


9. Liability

The seller's liability is limited to the amount paid for the License. The seller cannot be held liable for:

  • Interruptions of service due to third-party platforms (Garmin Connect IQ, Google Calendar API, weather providers);
  • Data loss on your Garmin device;
  • Incompatibilities arising from future updates to Garmin firmware or operating systems.

The free features of KairosEye remain available even if premium features are temporarily unavailable.


10. Intellectual Property

KairosEye, its source code, designs, and content are the exclusive property of David MARMONT. Purchasing a License grants you a personal, non-exclusive, non-transferable right to use the premium features of KairosEye. The License may not be resold, shared, or transferred to another person.


11. Personal Data

Data collected during purchase (email address, subscription status) is processed in accordance with the Privacy Policy.

Payment data is processed by Stripe under their own privacy policy; the seller does not store payment card details.


12. Applicable Law and Disputes

These Terms are governed by French law.

In the event of a dispute, an amicable resolution will be sought first by contacting [email protected]. If no amicable solution is reached, the consumer may resort to a certified consumer mediation service. As a last resort, competent French courts will have jurisdiction.

EU consumers may also use the European Commission's Online Dispute Resolution platform.
